In 8 out of 10 cases, email collections were not complete and typically under a motion to compel with parties having to go back and figure out why they were missing chunks of email for one or more custodians. This type of failure causes shifts in momentum, drives cost and ultimately leads to sanctions to the extent the missing email would have been dated after anticipation of litigation. There is also a general fear of targeted collections not being sufficient or complete and a desire to weigh that risk against the cost of "over collection" as it relates to eDiscovery costs – creating obvious and unhealthy tension.

Questio risk reduction is built on the following requirements:

  • The client must satisfy their obligation to preserve but have the ability to then target data from the collection in a teaspoon approach rather than boiling the ocean.
  • The client must be warned immediately post ingestion about gaps in email and other documents rather than post production where significant costs have been incurred.
  • For the foreseeable future, parties will continue to negotiate search terms and argue about their application, however, the client must have a mechanism by which they can FULLY validate custodians
  • The client should be able to validate terms in a way that will materially decrease the volume of false hits before incurring processing, hosting & document review charges
  • UnitedLex must provide a diverse team of SMEs that understand the issues of the case as well as the associates. These SMEs must run the applications that achieve desired result of significantly reducing the volume of data prior to processing in order to truly reduce the cost associated with eDiscovery.

While not alone, the legal industry is struggling to keep up with compounding data that drives the volume of documents that must be considered for litigation and regulatory requirements. Even with eDiscovery unit rates crashing, total cost of discovery continues to increase with rapidly increasing data volumes.

On average, 80% of documents processed and promoted to review and hosted are not responsive. The primary reason is that the legal teams are not able to interact with rapidly expanding data sets to validate search results until they are processed and in a review platform, at which time, the bulk of the eDiscovery cost has been incurred.

Questio deals with this challenge through an innovative multi-stage data reduction process that focuses on eliminating the documents that are irrelevant or responsive to search terms but are false hits prior to incurring processing costs.
